- In order to attempt to have the courts shorten your Chapter 13 plans, you must be able to show a change in your circumstances from the date your originally fined for bankruptcy. Changes which may be considered is loss of employment, divorce or an unexpected medical situation.
- As part of shortening your Chapter 13 plan, the courts may also lower the amount you have to pay back each month. In some situations the courts will re-file some of your remaining debt filed in bankruptcy as a Chapter 7.
- Should your situation drastically change, the shortening request of your Chapter 13 plans, may result in the courts re-filing all of your remaining debt into a Chapter 7. In this case, you will not have to pay back any of your remaining payments left in your original bankruptcy filing.
