- 1). Possess a written statement of transportation that complies with Section 107.01, which requires that the name of the shipper and consignee be clearly listed, along with the origin and the destination of the shipment. If the alcohol is purchased for personal consumption, then under Section 107.08, you do not need a transportation license or permit.
- 2). Present the written statement upon request by an authorized public official. The written statement must be presented by the transporter to any Liquor Commission representative or peace officer upon request, because it is primary evidence of your legal right to ship the alcohol. This requirements applies to both liquor and beer under Section 107.01.
- 3). Insure that there is no open container of alcohol in the passenger area of your vehicle. Under Texas Penal Code Section 49.031, no open alcohol container can be in the cabin area of your car, which under Texas law includes a container with a broken seal. Note that a locked glove box, the trunk and the area behind the last seat of the vehicle are considered safe zones because they are not within reach of the driver.
