How to Legally Change the Name of a Business

    • 1). Research new business names to find one that is not in use by another business in your state. Use registered business name databases provided by your state's secretary of state's office, local business directories and the Internet to determine if you can use the new business name.

    • 2). Contact the secretary of state's office to request a business name change form or certificate of amendment form if your business is registered as a corporation, partnership or limited liability company (LLC). Contact the county clerk's office if your business is a registered sole proprietorship to request a business name change form. Return forms along with the appropriate fees as required.

    • 3). Notify the Internal Revenue Service (IRS) of a business name change. Visit the Internal Revenue Service website for more information.
