Case Study: Claims Against The Police

In 2010 a group of 4 friends were stopped by the police whilst driving home. Surrounded by police cars sirens blaring and lights flashing the friend stopped. Quickly they were surrounded by a number of armed officers, weapons drawn, shouting conflicting instructions and obscenities at them. Terrified the friends didn't know what to do. An officer then smashed the driver's side window with his gun, showering the occupants with glass, and then dragged the driver out of the vehicle and to the ground.  The other occupants were also powerfully removed and handcuffed.

The police had suspected the vehicle of containing fire arms, the problem was they got the wrong vehicle and the 4 occupants of the car they did stop and search were all left traumatised and in need of counseling after the incident.

Having had it brought to their attention that is was possible and that they had a viable case, the group contacted an experienced solicitor to help them make a claim against the police.

Whilst the police claimed that the mix up in vehicle was simply human error and put it down to the friends being in the wrong place at the wrong time, the solicitor persisted and eventually managed to get the police to admit liability and apologise for their mistake.
