How to File an I-140 for Nurses

    • 1). Visit the website of USCIS and click "Green Card through a Job" in the middle of the homepage, under the larger heading of Green Card (Permanent Residence). Read through the first three paragraphs then click the link to "Form I-140, Immigrant Petition for Alien Worker" on the right side of the screen. Print the petition and the instruction booklet.

    • 2). Read the instruction booklet carefully and fill the petition out with black ink. Answer every question, providing an "N/A" for questions that are not applicable.

    • 3). Gather the required paperwork, including tax information on the business the nurse will work in, proof of continuous employment and proof of the the alien's experience in the nursing field. Obtain a U.S. postal money order made payable to the U.S. Department of Homeland Security. As of June 2011, this fee is $580.

    • 4). Enclose the application, documents and money order in an envelope. Mail the package certified mail, to the appropriate lock-box facility listed.

    • 5). Receive a mailed notification that USCIS has received your petition. Send this to the alien nurse, so that he may begin to apply for a green card with Form I485, Application to Register Permanent Residence or to Adjust Status.
